Darin Marx

Darin Marx focuses his practice on civil and probate litigation and has extensive experience with large, complex cases and has achieved many substantial recoveries for his clients.

In the civil context, Darin concentrates on issues affecting businesses and agri-business and has represented companies in agriculture, pharmaceuticals, technology, construction, and financial institutions. His expertise includes handling contract disputes, mechanics’ and designer liens, corporate governance and shareholder disputes, among other areas of the law.

As a business litigator, Darin has achieved many substantial settlements for his clients. He represented shareholders in challenging actions taken by a board of directors and CEO in a retail business with operations in several states, resulting in shareholders regaining control over the corporation and a reversal of prior actions of the board of directors and CEO.

He represented the seller of perishable agricultural products in enforcement of PACA rights and California Producer’s Lien rights against a secured lender that took the buyer’s accounts receivable and other assets. Darin recovered in excess of $500,000 for the seller. He also represented an agricultural grower in connection to an improperly designed, constructed and maintained water well, obtaining in excess $500,000 in damages for the grower.

In the area of probate litigation, Darin focuses on the obligations of trustees and fiduciaries in estate management and on issues affecting the validity of trusts, wills, and related documents. He has protected estates’ interests with significant outcomes. He represented a trust beneficiary in challenges to expenditures by a corporate trustee and recovered more than $400,000 for the trust beneficiary, among many other successes.

Darin first came to Ventura County as a student at Thomas Aquinas College, where he earned a degree in liberal arts in classical studies. He graduated with Distinction with a law degree from McGeorge School of Law in Sacramento in 2002. He was a member of the Order of the Coif and the Justice Traynor Honor Society. Prior to joining Lowthorp Richards in 2006, he practiced law in Los Angeles and New York.

An Ojai resident, Darin enjoys hiking the trails there and the surrounding Los Padres National Forest, and spending time with his wife, Melanie, and their four children.
